When should a Data Processing Agreement be used?
This document is to be used in circumstances where a service provider (the Processor) is processing personal data belonging to the client (the Controller) on behalf of the Controller in the UK. Examples include data hosting and marketing/IT/HR services being provided by the Processor to the Controller under a separate contract. This document relates to a controller-to-processor relationship. Please seek legal advice for further assistance regarding the differences between a controller-to-controller relationship versus a controller-to-processor relationship.
This document covers the parties’ data protection obligations only and does not cover the commercial aspects of any particular deal between the parties, for example pricing, service warranties, liability and ownership of rights.
